Burlington Law Membership Terms and Conditions

In essence Burlington Law Membership is designed to provide initial legal advice, and if required legal representation, to ordinary members of the general public who for some reason unexpectedly find themselves having to engage with a lawyer on an issue which was hitherto unplanned, providing access to expert help without fear of the eventual cost.

Burlington Law is not intended to provide legal advice on such matters as Wills, Divorce, Family law, Criminal law, or Property transactions, although Burlington Law Membership can provide fixed fee's relating to these matters, on request, thus removing the worry of on-going costs.

ACCEPTANCE OF THESE TERMS AND CONDITIONS

By becoming a Burlington Law member you agree to be legally bound by these Terms of Membership and to comply with them at all times. We amend our Terms of Business from time to time, so please see https://burlingtonlaw.co.uk/terms/ for the latest version.

GENERAL TERMS

  1. Your membership term is one month (commencing on the date we accept your application) and will renew automatically on a monthly basis until cancelled. You can cancel at any time.
  2. Our lawyers work during business hours, 9am to 5pm, so if we received your enquiry outside those hours please be assured we will get back to you during normal business hours.
  3. You must be over 18 to become a member.
  4. Membership is only available to UK residents, excluding Northern Ireland.
  5. Burlington Law membership subscription monthly fee is payable by Credit Card on a monthly debit.
  6. Burlington Law Membership entitles the member to legal action insurance to the maximum cover of £250,000 (exclusive of VAT).
  7. Such legal action insurance will only cover issues and disputes governed by the law of either (1) England and Wales and/or (2) Scotland.
  8. Proceedings are subject to the advice of Counsel. The case will only proceed if it has a 60% or higher chance of success.
  9. Your membership does not cover any pre-existing issues or disputes. By way of example only, if you have a boundary dispute and the reason for that boundary dispute is in place when you become a member, that constitutes a pre-existing condition. In a case such as this, we will do our best to offer you low cost legal representation but not through the membership.   10. In the event of non-payment of the monthly fee, membership will be suspended until payment is received. In the event of an issue or dispute arising during any period of suspension, that issue or dispute will be treated as a pre-existing issue or dispute and cover will not be provided.
  11. Should we investigate a legal issue on your behalf and during the investigation it is found to have existed before your membership began, we reserve the right to charge you for any time spent on the case.
  12. Additional cover relating to certain legal cases or issues are available with each case being assessed individually.
  13. Membership Exclusions. Your membership will not cover:
    1. Divorce and divorce mediation
    2. Child custody and access
    3. Child support
    4. Financial settlements
    5. Property transactions and associated legal work
    6. Wills, trusts and inheritance issues
    7. Criminal law
    8. Corporate law
  14. Burlington Law Membership is only available to private individuals and does not provide cover for commercial or business litigation.   15. Membership of Burlington Law is non-transferable.
  16. Any existing legal cases which are currently in process under Burlington Law membership monthly membership fees will continue until conclusion of the legal action, on behalf of the member.
  17. Burlington Law Ltd.  reserves the right to refuse membership or to revoke membership, in the case of misuse.
  18. Membership entitles the cardholder to legal advice and legal representation up to the maximum cover by a fully qualified lawyer.
  19. Legal cases involving dispute between Burlington Law members, Burlington Law Ltd. reserves the right to arbitrate prior to any court action taking place.

JURISDICTION

This agreement is governed by the law of England and Wales.

For the benefit of the member the parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to hear, settle and/or determine any dispute, controversy or claim (including any non-contractual dispute, controversy or claim) arising out of or in connection with this agreement, including any question regarding its existence, validity, formation or termination. For these purposes, each party irrevocably submits to the jurisdiction of the England and Wales courts.
